The present conditions of sale are concluded on the one hand by the company ELEMM, called "seller", registered with the RCS of Evry under the number 883 736 837, and, on the other hand, by any natural or legal person wishing to carry out a purchase via the website www.ele-mm.fr, hereinafter referred to as "the buyer".

Article 1. Acceptance of the GCS

These conditions of sale aim to define the contractual relationship between ELEMM and the buyer and the conditions applicable to any purchase made through the site www.ele-mm.fr.

The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, which the buyer acknowledges having read prior to his order.

The ELEMM company retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or with the aim of improving the use of the site.

Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

​

The items offered are those which appear on the site www.ele-mm.fr, within the limits of available stocks.

Each item is presented on this site in the form of a description summarizing its main characteristics (materials, composition, etc.).

The photographs presented on this site are taken to be as faithful as possible but are not contractual.

Article 3. Rates

​

The prices appearing on the product sheets are prices in Euros (€) excluding taxes.

Since ELEMM is a microenterprise, VAT is not applicable according to art. 293b of the CGI.

Any subsequent change in VAT may be reflected in the price of the products. ELEMM reserves the right to modify its prices at any time, it being understood, however, that the price concluded on the day of the order will be the only one applicable to the buyer.

The delivery costs are those indicated in detail in the "Deliveries and Returns" section, or can be viewed here .

Shipments are made via Colissimo for home delivery or via Mondial Relay for delivery to a relay point, or home for certain countries of the European Union.

Article 4. Order and terms of payment

​

To place an order, the buyer selects the products he wishes to order, adds them to the basket, under his sole responsibility, specifying the desired quantity.

ELEMM offers the buyer to pay for his order, by credit card or by PayPal.

For cards domiciled outside France, they must be international bank cards of the VISA/MASTERCARD type.

Online payment by credit card, on our website  www.ele-mm.fr, is secure . The information transmitted is encrypted  and cannot be read during network transport.

After validation, the buyer will receive the information to redirect him to the secure PAYPAL interface in order to securely inform his PayPal account references or personal credit card.

If the payment is accepted, the order is recorded and the contract definitively formed. The card is debited immediately.  In accordance with the provisions of the Monetary and Financial Code, the commitment to pay given by PayPal account or by bank card is irrevocable.

The confirmation of an order entails acceptance of these conditions of sale, the recognition of having perfect knowledge of them and the renunciation of availing oneself of its own conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction.

If the buyer has an e-mail address and if he has entered it on his order form, ELEMM will send him by e-mail confirmation of the registration of his order.

Article 5. Retention of title

​

ELEMM retains full ownership of the products sold until full payment of the price, in principal, costs and taxes included.

Article 6. Withdrawal, condition of returns, reimbursement

​

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen (14) working days from the delivery of their order to exercise their right of withdrawal and thus make a return. of the product to the seller for a refund without penalty, except for the cost of return.

Here are the steps to follow:  

​

1- the buyer must make a prior return request to the seller, notifying us of his wish to return. Or, by sending us an email at the address  contact@elemm.fr  or by writing to us via  Contact form.

2- Upon validation of the return, the buyer must return the item(s) in its original and complete condition (packaging, accessories, etc.), accompanied by the duly completed return slip.

3- The product must be returned at your expense to the following address: ELEMM - at RAMIARAMANANA at 7 rue Albert Einstein - 91240 Saint Michel sur Orge - France.

4- After verification of the returned items, the refund is made by check or PayPal, within a maximum period of 14 days following the date of receipt of the returned item.

NB: For an exchange,

We do not offer exchanges. The buyer must return the item as indicated above and reorder the item they want.

Article 7. Delivery

​

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Shipments are made by La Poste via COLISSIMO, delivery service with tracking, delivery with or without signature, or by Mondial Relay.

Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

ELEMM may provide the buyer with the tracking number for their package by e-mail.

The buyer is delivered to his home by his postman or at a relay point, depending on the choice made when ordering.

In the event of the buyer's absence, he will receive a delivery notice from his postman, which allows him to withdraw the products ordered from the nearest post office, for a period indicated by the postal services.

The risks associated with transport are the responsibility of the purchaser from the moment the items leave our premises. The buyer is required to check, in the presence of the deliverer, the condition of the packaging of the goods and its contents on delivery.

In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Delivery error  

​

The buyer must formulate with the seller the same day of delivery, or at the latest, within 48 hours of delivery, any complaint of error of delivery and/or non-conformity of the products in kind, or in quality compared to to the indications appearing on the order confirmation. Any complaint made after this period will be rejected.

The complaint can be made at the choice of the buyer: by telephone, or by email or via our contact form.  Our website operates 24 hours a day, we receive complaints, even on weekends and public holidays. All these contact details can be consulted on the "contact" page.

Any complaint not made in the rules defined above, and within the time limits cannot be taken into account and will release the seller from any liability vis-à-vis the buyer.

Upon receipt of the complaint, the seller will assign a return slip to the customer. 

The buyer must return the item(s) in its original and complete condition (packaging, accessories, etc.), accompanied by the duly completed return slip.

The product must be returned to the following address: ELEMM - at RAMIARAMANANA at 7 rue Albert Einstein - 91240 Saint Michel sur Orge - France.

In this case only, the return costs are the responsibility of the seller. 

After verification of the returned items, the refund is made by check or PayPal, within a maximum period of 14 days following the date of receipt of the returned item.

Article 9. Guarantee

​

All the products supplied by the ELEMM company benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the ELEMM company which will take it back, exchange it or reimburse it. All complaints, requests for exchange or reimbursement must be made according to the rules specified in article 6 and article 8 above.

Article 10. Liability

​

ELEMM, in the distance selling process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 11. Intellectual property

​

All elements of the ELEMM site are and remain the exclusive intellectual property of the ELEMM company. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

Article 12. Personal data

​

The ELEMM company undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 13. Settlement of disputes

​

These general conditions of distance selling are subject to French law. For all disputes or disputes, the buyer will first contact the seller to obtain an amicable solution. In the absence of agreement, the French courts will have sole jurisdiction.
